European and national Courtcases relevant for SRF

This page is intended to give information about decisions or expected decisions of the European Court of Justice or competent national courts in the field of SRF.

 

The most relevant court for important decisions is actually the Opens external link in new windowEuropean Court of Justice which has in several cases made important decisions about the interpretation of European waste legislation on question like:

  • when does a material start or end to be a waste

Especially on the waste/non-waste question are several decisions in which the ECJ takes a very rigid position based on actual European legislation.

 

Another important decision was made by the Dutch Highcourt on the export of certain SRF from the Netherlands to Sweden. Information about this case can be found on the website of the Opens external link in new windowRaad van State (look for ICOVA). The textes will be in Dutch.

The court found it possible to say, that under certain conditions a SRF may have been processed to become a non-waste.
