European and national Courtcases relevant for SRF

The most relevant court for important decisions is actually the European Court of Justice which has in several cases made important decisions about the interpretation of European waste legislation on question like:

• what is the difference between recovery and disposal
• when does a material start or end to be a waste

Further You will find a searching possibility for the site allowing to look for any decision of the last years as well as the pladoyers of the general attorneys of the ECJ.

Especially on the waste/non-waste question are several decisions in which the ECJ takes a very rigid position based on actual European legislation.

Another important decision was made by the Dutch Highcourt on the export of certain SRF from the Netherlands to Sweden. Information about this case can be found on the website of the Raad van State (look for ICOVA). The textes will be in Dutch.

The court found it possible to say, that under certain conditions a SRF may have been processed to become a non-waste.
