Legislation
European Legislation in the field of secondary fuels is derived as well from the environmental side as from energy production.
Important legislation to consider in this field is e.g.:
The waste incineration directive
The waste incineration directive sets the rules under which solid recovered fuels can be used in dedicated incinerators or in industrial plants using solid recovered fuels as fuels to substitute primary fuels (like coal, lignite or oil)
The RES-E directive
Directive 2001/77/EC of the European Parliament and of the Council of 27 September 2001 on the promotion of electricity produced from renewable energy sources in the internal electricity market
The waste framework directive
The waste framework directive sets the important definitions in the field of waste management, amongst them the definition of waste and the definition of disposal and recovery.
Actually the European Commission is preparing a redrafting of this directive especially with the aim to improve those definitions above, which did due to their complexity cause an increasing amount of cases to be decided at the European Court of Justice.
The Commission will probably make proposals for standards when certain waste cease to be a waste after treatment and to improve the Annexes IIA and IIB which list the disposal and recovery methods.
